Tony Nguyen: A Chance for Truth in Little Saigon

Tony Nguyen, director of Enforcing the Silence, responds to criticism of FRONTLINE and ProPublica’s new documentary investigating the murders of Vietnamese-American journalists, Terror in Little Saigon. An overview of the documentary and the controversies around it can be found here.

Tony Nguyen

I’m a second-generation Vietnamese American. The son of a refugee who escaped Vietnam in 1975. Four years ago I released a documentary called ENFORCING THE SILENCE about Lam Duong (Dương Trọng Lâm), the first Vietnamese journalist to be assassinated on US soil. It was voted in by a screening committee to play at the 2011 Vietnamese International Film Festival in Orange County, California, but was ultimately pulled from the program for fear that it would incite anger and protest from older, anti-communist Vietnamese Americans, according to festival organizers. The festival told me the film’s treatment of a militant group called the Front was too harsh and inaccurate, that they were not a joke as one of my interviewees said. That’s fine. That’s their opinion. My philosophy is, keep it moving.

Fast forward to October 3, 2015. PBS Frontline and investigating reporting organization ProPublica broadcasted TERROR IN LITTLE SAIGON, a TV documentary written and directed by Richard Rowley with A.C. Thompson as the correspondent and lead reporter. I’m an associate producer on the show and have been involved since its inception. I helped guide the crew with ideas of who to focus on, what to look into, who to interview, and so forth. The box of research documents that A.C. is looking through in the film is mine. It was my idea for A.C. to reach out to Richard Rowley to direct, as I am a fan of his films (watch Oscar-nominated DIRTY WARS) and his exceptional cinematography. I also provided feedback on the show’s rough and fine cuts.

Some Vietnamese Americans are angry with the Frontline documentary’s portrayal of the older generation and what they see as an unjust focus on the Front, a group that law enforcement has linked to some of the journalist killings, if not all. Some say the show’s title, TERROR IN LITTLE SAIGON, is loaded and sensational. Okay. But terror is what Vietnamese American journalists themselves have used to describe the threats, the violence, the murders –“terrorism against newsmen.” The five Vietnamese journalists were all killed in areas where there are “Little Saigons” — San Francisco, Houston, Orange County, and Northern Virginia. The title may be a bit on the nose, but it is not an exaggeration of history.

Journalist A.C. Thompson (left) with Dam Phong's son Nguyen Nguyen (right)

Journalist A.C. Thompson (left) with Dam Phong’s son Nguyen Nguyen (right).

Some say the program is another example of the white savior complex, of the white man swooping in to save the day. Uh, it’s an investigative film that follows an investigative reporter, A.C., as he investigates a cold case, the unsolved murder of investigative journalist Nguyen Dam Phong. In the show he meets with the victim’s family members and friends, law enforcement, those suspected of the killing or of ordering it. He even goes on the same journey as Dam Phong and tries to track down the Front’s military base in Thailand. And note: A.C.’s been an investigative reporter for over 15 years writing stories about grave injustices, one of which helped free an innocent man from jail, 13 years after his conviction. He’s been a correspondent on three prior Frontline shows that you can stream on its website. He is a hell of a truth-seeking reporter who views the slain Vietnamese journalists as his colleagues.

Tina Ha Giang of the newspaper Nguoi Viet interviewed me last week, but I guess she couldn’t fit any of my comments in her articles on the subject. What I told her was that I think the Frontline piece is a major breakthrough for achieving what I could not do in my film, and that is: include the on-camera voices and perspectives of victims’ family members and that of the suspected criminals, former Front members and leaders. This has never been done before on film. We even included former Front leader Nguyen Xuan Nghia talking about how this kind of show makes the Vietnamese American community look bad, as if the victims’ family members are not a part of the community.

NguyenXuanNghia

Former Front leader Nguyen Xuan Nghia being interviewed by A.C. Thompson.

What people are calling rumor and gossip of terror by the Front and its followers (threats, intimidation and physical violence) is documented in thousands of pages of FBI and police files and through interviews with former Front members and leaders, and with victims of their wrath. This includes testimony from current San Jose Councilmember Tam Nguyen who described being beat up by Front members in the early 1980s for things his newspaper wrote about the Front.

A few years ago during a panel where I was criticized for my film about Lam Duong, I replied that my film or any other shouldn’t be considered the definitive piece. Instead I encouraged others, especially Vietnamese Americans, to look into the murders of our journalists and see where leads and evidence take them.

terror in little saigon2

Now, after the release of TERROR IN LITTLE SAIGON, some people are, predictably, attempting to label me a Communist agitator, a ridiculous assertion. They are suggesting my work on Lam Duong was underwritten by the Socialist Republic of Vietnam, which is bogus; in reality, the project was crowdfunded through Kickstarter and one person in Vietnam gave $20. So much for the great Commie conspiracy. And they are portraying A.C. Thompson and the Frontline team as dupes who were somehow swayed by my secret agenda.

The truth is a lot less exciting: We worked together to tell a difficult investigative story, following the facts wherever they led us.

As a community, what do we care about? Some Vietnamese Americans seem to care more about protecting a certain image of Little Saigon than holding the authorities accountable for failing to arrest the killers and those who terrorized the community. I am interested in investigating the murders of our journalists because solving them would not only bring closure to the victims’ family members, but I believe would do a tremendous service and provide resolution to all our communities around the country.

So, to me, what we have is an opportunity to call on the FBI and local police to re-open these cases and utilize the knowledge and experience we have today to help solve them. There are people in our communities who know the truth and I hope one or more of them will come forward and no longer remain silent. As Nguyen Dam Phong’s son Tu said, “For us, we just want an answer… [that] we never got from police or anybody.”

Tony Nguyen made his directorial debut with ENFORCING THE SILENCE, a documentary that the LA Times called “an uplifting portrait” of slain journalist Lam Duong. He recently released GIAP’S LAST DAY AT THE IRONING BOARD FACTORY, winner of the 2015 Loni Ding Award for Social Justice Documentary. A collaboration with Academy Award-winning filmmaker Steven Okazaki, GIAP’S LAST DAY is the first of an autobiographical series that provides a fresh take on the refugee experience in America.

    I Tony,
    You ‘re a good man
Assure you that there is at least one old member of the QLVNCH who admire your effort of making “Enforcing the silence”, and those of A C Thompson, ProPublica, PBS.
Had been a member of QLVNCH, spent time in “cai tao” plus 10 years under Communist VN I experienced varied political views of the Vietnamese which are generally so contradicted each others that they become somewhat uncontrolled themselves listening of the opposite side.
Very hard to persuade both of these groups of persons.
But we ask for justice solely FOR JUSTICE because FOR JUSTICE is our consciences.
Furthermore, terror is a weapon of the cowards like robbers, party members, …. and they might strike again if we are not vigilant.

Just in case someone would put all of us all in the same basket (a basket case(?) bỏ chung một rọ. The term “community” is a misnomer. Bằng Phong – Đặng văn Âu who wrote the piece exposing The Front/Mặt Trận was a pilot in the South Vietnam Air Force.
Sometimes I wonder about the one-size-fits-all moniker “cộng đồng” (community) I think more to the point it means “cộng đồng người Việt hải ngoại” (overseas Vietnames community). In the current brouhaha about the documentary “Terror in Little Saigon” (now aptly called docudrama), a number of people – specifically the Việt Tân people – (reincarnated from the Front/Mặt Trận) would have us believed that the docudrama would give the “community” a bad name!

There are people who are activists and dissidents, struggling against the continuing excesses and abuses the government VN, they flatly do not support Mặt Trận/The Front or Việt Tân. They respect the honorable efforts and endeavors of those in the communities both back in VN and here who struggle against the current VN leadership for the very same things they abhor in The Front, namely human rights abuses, corruptions, lies, deceptions and excesses. So why does Việt Tân folks continually liken themselves to the “community”?

Because by “đánh bùn sang ao” pulling their bloody wool over our eyes they would give the uninformed the mistaken notion that Frontline and ProPublica’s “Terror in Little Saigon” is attacking the (anti human rights violators) Vietnamese community and ipso facto would give ‘us’ (if we belong to this community) a black eye. Hogwash! This would be true only if all honorable Viet democratic idealists and activists – and esp. Viet journalists – who oppose VN today would aquiesce to the terror and murders of the 80’s. Aren’t they using the very same tactics of the communist whose terror and violence that we abhor and struggle against still persist until today?

Some even say that those assassinations were justified because the victims were Communists or sympathizers (yes Dương Trọng Lâm, may fit the bill!) This is a blatant disregard of the truth. Journalists Đạm Phong, Lê Triết and other murdered victims are anti-communist, their transgressions and sins had been published articles denouncing the Front as charlatans and impostors, and the Front incursions into VN from the borders of Thailand and Laos are elaborate set ups, hoaxes designed to take advantage of the people anti-Communist climate of the time for money.

THE MURDER OF OUR EXILED VIETNAMESE JOURNALISTS REMINDS US OF MANY HUNDREDS OF WRITERS, JOURNALISTES, BLOGGERS, HUMAN RIGHTS DEFENDERS VICTIMS OF ARBITRARY POLITICAL POWER, RELIGIOUS FANATICISM AND INTOLERANCE, SECRET POLICE SURVEILLANCE AND MAJOR ORGANIZED CRIME IN SEVERAL STATES IN THE WORLD, INCLUDING VIETNAM, CHINA, NORTH KOREA, IRAN, SYRIA, ERYTREA, MEXICO, HONDURAS, ETC. MAY WE BRING TO THE KNOWLEDGE OF YOUR READERS THE GLOBAL SITUATION AS REPORTED IN THE FOLLOWING ARTICLE :
    *********************************************************************************************************************************
PERSECUTED, THREATENED WITH DEATH, DEPRIVED OF FREEDOM, WRITERS AND JOURNALISTS ARE ON THE ROADS OF EXILE.
We do not forget, 20 years ago, on 10 November 1995, Ken Saro-Wiwa was executed by the Nigerian military dictatorship because he told the truth. And the murder of Anna Politkovskaya in Russia, on 7 October 2006 and that of Hrant Dink in Turkey, in January 2007, are the most glaring examples and revolting crime. Or, in Viet Nam, PEN International also mourned the painful and unjust death of blogger and teacher Dinh Dang Dinh occurred on 3 April 2014 at his home, after being sentenced in August 2012 to six years in prison. He was amnestied too late on 21 March 2014, when he was only a dying skeleton devoured by stomach cancer in prison. Shortly before his death, Dinh Dang Dinh said that when he discovered blood in his bowel movement, he formulated many requests to be admitted to a hospital for examination but that the camp warders beat him instead of giving him the adequate treatment he urgently needed. 69-year-old poet Nguyen Huu Cau serving a life sentence in lieu of a death penalty imposed in 1983 was also amnestied in March 2014 for health reasons: he suffers from severe heart failure, blindness in his left eye, failing vision in his right eye, and is almost deaf. While his release is welcome, he should never have been in prison in the first place. We continue to work together to raise public awareness to the plight of persecuted writers and journalists who are in jail for their writings or their opinion.

As a reminder, sent by the RFI to Mali, Ghislaine Dupont and Claude Verlon were murdered on 2 November 2013. Since their atrocious death, blood does not stop flowing. Charlie Hebdo was reduced to ashes at the heart of Paris. Elsa Cayat, Jean Cabut, Philippe Honoré, Bernard Verlhac, Georges Wolinski, Stephane Charbonnier, Bernard Maris and Mustapha Ourrad were killed unjustly. Everywhere, pen and pencil continue to be confiscated or destroyed. Drawings, songs, poems are targets of arbitrary political power, religious fanaticism and intolerance, secret police surveillance and major organized crime.

During the last 12 months, since 2 November 2014, according to PEN International, at least 49 writers, poets, journalists, bloggers, cartoonists, correctors and filmakers have been murdered, with impunity. We deplore 8 killings in France (Charlie Hebdo), 6 in Mexico (José Moisés Sanchez Cerezo, Ismail Diaz Lopez, Gerardo Nieto Alvarez, Juan Mendoza Delgado, Filadelfo Sanchez Sarmiento, Ruben Espinosa), 5 in Bangladesh (Avijit Roy, Washiqur Rahman, Ananta Bijoy Dash, Niloy Chakrabarti, Faisal Arefin Dipan), 5 in India (Jagender Singh, Sandeep Kothari, Raghavendra Dube, Malleshappa Madivalappa Kalburgi, Mithilesh Pandey), 4 in Iraq (Thaer Alali, Ammar Al-Sahahbander, Raed Al-Joubouri, Suahaa Ahmed Radhi), 2 in Brazil (Marcos de Barros Leopoldo Guerra, Evany José Metzker), 2 in the Philippines (Nerlita Ledesma, Gregorio Ybanez), 2 in Syria (Kenji Goto Jogo, Khaled al-Asaad), 2 in Turkey (Ibrahim Abdulkadir, Firaz Hamadi), 1 in Azerbaijan (Rasim Aliyev), 1 in Denmark (Finn Nørgaard), 1 in Egypt (Shaimaa El-Sabbagh), 1 in Guatemala (Danilo Lopez), 1 in Kenya (John Kituyi), 1 in Mozambique (Paulo Machava), 1 in Pakistan (Zafarullah Jatak), 1 in Peru (Fernando Raymondi Uribe), 1 in Poland (Lukasz Masiak), 1 in Somalia (Abdullahi Ali Hussein), 1 in South Soudan (Peter Moi Julius), 1 in Ukraine (Oles Buzyna), and 1 in Yemen (Abdul Karim Mohammed Al-Khaiwani).

At the same time, the Writers in Prison Committee has recorded about 900 cases of attacks against our bearers of dreams and adventures, witnesses of human realities around the world. The PEN Congress in Quebec, last October, has adopted resolutions on the very critical situation of the freedom of expression, including those concerning Bangladesh, Ethiopia, Honduras, Iran, Mexico, China, Tibet, Viet Nam and Turkey, among many others.
The Congress delegates have expressed their concern about the plight of women writers and men of letters among thousands of their compatriots reported missing in Mediterranean, in their actual deadly exodus. Exiled Vietnamese Writers recalled also the tragedy of many hundreds of thousands Vietnamese boatpeople refugees drowned under the seas in Asia-Pacific after the arrival of communist troops in April 1975.
The 15 November 2015 will be the 34th World Day of the Imprisoned Writer, just 2 weeks after the 2nd International Day to End Impunity for Crimes against Journalists.
On the occasion of these Days – Events, the Suisse Romand PEN Centre, one of the PEN International’s 145 Centres, addresses to you: Please join your voices to ours, to those thousands of writers, poets, journalists, bloggers, translators and publishers, as well as friends and sympathizers of PEN International, for supporting victims of the tragedies of those being persecuted and punished for freedom of expression.
The following major cases, among many others, inspire to us profound concerns:

    – Juan Carlos Argenal Medina, Hondurian journalist, assassinated on 7 December 2013 because he would have had the courage to denounce corruption. The circumstances of his death have not been clarified. No progress in investigations

    – Raif Badawi, Saudi blogger and publisher, sentenced in 2012 to 10 years in prison, 1000 lashes, a fine, a travel ban for ten years and a ban on same duration to collaborate in the media for ‘’insult to Islam” and ” creating a Liberal website’’.

    – Amanuel Asrat, Eritrean poet, critic and editor of the major newspaper The Times. Arrested on 23 September 2001 during a crackdown on public and private media. Detained without charge nor trial.

    – Patiwat Saraiyaem et Pornthip Munkong, Khadija Ismayilova (f), Thai student and female student, arrested in August 2014, sentenced to 2 years and a half in prison for lèse-majesté crimes by participating in the staging of a play at Thammasat University in 2013.

    – Khadija Ismayilova, Azerbaijani investigative journalist, famous for his investigations into corruption at the top of the state and its critics, arrested on 5 December 2014 in a fabricated case. Sentenced on 1 September 2015 to 7 years and a half in prison for ”embezzlement and tax evasion’’.

    – Ho Thi Bich Khuong (f), Vietnamese blogger, human rights defender and author of a memoir in prison, satirical poems and online articles. Interviewed by foreign radio, she denounced the abuse of power against poor women peasants. In June 2006, her husband was mysteriously murdered in their village. Having served two previous prison sentences in 2005 and 2007, she was arrested again in January 2011 and sentenced in December 2011 to 5 years in prison and 3 years in probationary detention, for “propaganda against the Socialist state’’. Tortured in prison and badly beaten by common law detainees. Other aggressors broke her left arm during pre-trial detention. She still suffers from a long-untreated broken collarbone due to lack of adequate medical care. She has frequently been held in solitary confinement for protesting against detention conditions by hunger strikes. She is in very poor health.

There are criminal cases people can never solve, see OJ Simpson’s verdict. “Provide resolution to all our communities around the country”, huh ? ! No wonder Vietnamese people who experienced with all kind of political abuses from all fronts are mad of you, Wake up, em nhỏ.

What is the purpose of the video for using the Vietnamese Parade in 2000 – 201x in Little Saigon for the murders 30 years ago?
My family do not feel any terror in Little Saigon as long as we do not write/make any article/video/film that is misleading/haft truth/exaggerate to defame/harm/cause the others anger/outrage. You should make a research to survey Vietnamese people in Little Saigon to see if they feel terror before using the title: Terror in Little Saigon.
If you see/feel someone violent to you or to the others you should report to FBI anti-violent team. If FBI does not do their work, then you can write complaint/warning to DOJ to the President, and to the Congress. In USA please respect to the other and be careful if you want to do unprofessionally the work of DOJ/Court to accuse/judge someone/some organization. Anyone may kill me if I cause him/her outrage, infuriate, incense, anger, scandalize, offend, affront, shock, disgust. Both the person causing the anger and the person unable to control the anger are harmful for society. The Law should punish both, not only on the violent person but also the person caused some one to become violent. If you think ISIS represent for all Muslim as the Vietnamese murders in 19xx represent for the culture of Vietnamese Immigrant, the culture of Little Saigon, the Vietnamese-American mind …. , you will have big trouble.
You should ask US Gov, Congress, FBI, DOJ why “the five Vietnamese-American journalists were never solved”? as stated in one article: https://en.wikipedia.org/wiki/Assassination_of_Vietnamese-American_journalists_in_the_United_States

  11. Ho chi que says:

Tony Nguyen and ProPublica should direct the film to ask/demand the answer from FBI/DOJ and CIA for the truth because Government received tax money to do the investigation. If Government have reason not to disclose the truth for such people like Tony Nguyen, then Tony Nguyen may be careful “do not steps on the FBI shoes” and do not corporate with Chinese and Russian to defame the US like Edward Snowden did.

For all Vietnamese Journalist, please be careful, if you write an article either pro-Hanoi or support anti-communists, you may be killed.

Hanoi may kill you and blame on Anti-communism organization. It is 100% possible for Hanoi, because Hanoi has a lot money to do that and easily create a propaganda for this. It is communists’ habit of assassination during the Vietnam War and their propaganda is very powerful. Moreover, who can punish Hanoi if they do that? Who can control Hanoi?

How about anti-communists if they want to kill you and blame on Hanoi? It rarely happens because Anti-communist does not have enough finance/fun/money to do the assassination and do not have powerful media to blame Hanoi, except blaming the truth. Anti-communism organization do not have a 60-year experience/professional assassin organization as Hanoi. Moreover, the anti-communist easily get caught if they do something wrong by both Hanoi agents on US land and by US government/media/newspaper/film directors and Tony Nguyen. Anti-communist lives in scrutiny eyes by the entire world.

This is my theory for Hollywood to create film, not a judgement.

  12. Banh thi Vem says:

every normal person wants money, VC can buy any normal person for a little of two million dollars. VC can buy any anti-communist to kill other anti-communists or kill some one in order to destroy people trust/create bad reputation on some organization. VC can guarantee the safety and luxury live for the killers as well as his/her family in VN after the mission.

Take a look in VN today, VC hire gangsater/or pretend gangster to beat/kill their people

If any one is killed and had a background support VC, or was disliked by anti-communists, then his dead will cause every normal one easily pointing to/accuse the anti-communism organizations for the murder. It is why FBI know and think differently.

In fact, there is no trace of the killers because they are 75 year professional well trained and great rewarded team by VC. Only one killer, but being support/hide by 10 VC agents as in VC assasination during the VietNam War.

I m really worried for Tony Nguyen and his family. Hopefully, my writing can prevent the VC evil plan on him and his family.

“lies come in many forms. Partial truths, selective facts, out of context quotes and information, partial historical perspective and out right misrepresentation of facts. It is easy to manipulate the public. If you become aware of the methods of deception you are better prepared to sift through the propaganda for the few facts that are actually made available by our broadcast our news media. ”
“One obvious way news media can distort people’s views on reality is through bias
Quoting only two strongly polarized viewpoints
Giving one polarized side undeserved credibility
    Over-reporting specific crimes, especially murder
Repeating reporting of isolated, emotionally-charged events
    “Quick-and-dirty” news”

** Appeal to Emotion fallacy” This fallacy is committed when someone manipulates peoples’ emotions in order to get them to accept a claim as being true. More formally, this sort of “reasoning” involves the substitution of various means of producing strong emotions in place of evidence for a claim.

**Appeal to Pity” An Appeal to Pity is a fallacy in which a person substitutes a claim intended to create pity for evidence in an argument

“Progress is the mode of man. The general life of the human race is called Progress. The collective advance of the human race is called Progress. Progress marches on; it makes the great human and terrestrial journey toward the celestial and divine; it has its halts where it rallies the belated flock; it has its pauses where it meditates, in sight of some splendid Canaan suddenly unveiling its horizon; it has its nights when it sleeps; and it is one of the bitter anxieties of the thinker to see the shadow over the human soul, and to feel Progress asleep in the darkness, without being able to waken it. “” Perhaps God is dead”” said Gerard De Nerval one day, to the writer of these lines, confusing progress with God, and mistaking the interruption of the movement for the death of the Being. He who despairs is wrong…

What then is progress? We have just said, the enduring life of the peoples. Now, it sometimes happens that the momentary life of individuals offers resistance to the eternal life of the human race.”

My opinion: That was a motive/reason for Hoang Co Minh and his party of the FRONT.

Revenge is not always a good Vietnamese method. In Vietnamese culture, we understand very thing have cause and effect, a reason behind. (If there dead relative did not make the other outrage/madness unnessarily, then nothing happens. ) Therefore the traditional Vietnamese usually let it go to enjoy the present happiness with the belief that every evil will be punished/disclosed at the end even 200/300 years

It is unethical to blame the Vietnamese Vet coming to US after 1990, blame their families, blame their children paraded on the street, blame the meeting in restaurant 2014 …. It is not the way of tradition/real Vietnamese who believe everything have the cause and effect. If the dead person did not defame/lied/insulted the others, made the killer outrage/anger, then nothing happened. Just search for the name of the dead people, you can see how Newspaper and Law Enforcement spent so much time for the murders. It is not true as AC Thompson said that FBI did not care/ Law enforcement do nothing.

Therefore, be careful, we have Law enforcement system that help us to punish the wrong doing appropriately/correctly, even the small wrong thing like stealing food due to too hungry. Let the Law enforcement do their job and let the Court make a final judegement.

For the young Vietnamese-American who hate the older Vietnamese. It is normal. When I was young, I usually thought I could do better, smatter than the olders. I used to fight against the olders, criticized them, focused on their failure/negative things and ignored their positive .

Why the young have such belief and thinking? Is it ok? How to prevent it? What happiness if the young do not have such wrong belief?

    — Why the young have such belief and thinking? The Young, specifically the young educated by VC high school usually committed this behavior/belief. Historically, Communism began in 1900’s (traced back to the work of 16th-century English writer Thomas More). It is the period of a rational and philanthropic basis attempt to replace the religious . People at that time believe that science and reasoning can give them a correct picture of the world, a correct action on how to live a good life and how to build a good society …. they plan everything. Communists always have such 5 years, 10 years planning by reasoning, science …. Like the young rely totally on their thinking and reasoning and dream about their future, plan for their future ….

The young and communism have the same characteristic of rational and confuse Conscience as science. Here is a part of my writing about this:

Utopia, moreover, we must admit, departs from its radiant sphere in making war. The truth of tomorrow, she borrows her process, battle, from yesterday’s lie. She, the future, acts like the past. She, the pure idea, becomes an act of force. She compromises her heroism by a violence for which she should justly answer; a violence of opportunity and expediency, contrary to principles, and for which she is fatally punished. Utopia in revolt fights the old military code in her hand; she shoots spies, she executes traitors, she eliminates living beings and casts them into the unknown dark. She uses death, a solemn thing. It seems as though Utopia had lost faith in radiation of light, her irresistible and incorruptible strength. She strikes with the sword. But no sword is simple. Every blade has two edges; he who wounds with one wounds himself with the other.

This reservation make, and made in all severity, it is impossible for us not to admire, successful or not, the glorious combatants of the future, the professors of Utopia. Even when they fail, they are venerable, and it is perhaps in failure that they have the greater majesty. *** Victory, when it is according to progress, deserves the applause of the peoples; but a heroic defeat deserves their compassion. ***

** Defamation—also calumny, vilification, and traducement—is the communication of a false statement that harms the reputation of an individual person,

business, product, group, government, religion, or nation.[1]

Under common law, to constitute defamation, a claim must generally be false and have been made to someone other than the person defamed.[2]

Some common law jurisdictions also distinguish between spoken defamation, called slander, and defamation in other media such as printed words or

    images, called libel.[3]

** Blame is the act of censuring, holding responsible, making negative statements about an individual or group that their action or actions are socially or

morally irresponsible, the opposite of praise. When someone is morally responsible for doing something wrong their action is blameworthy. By

contrast, when someone is morally responsible for doing something right, we may say that his or her action is praiseworthy. There are other senses of

praise and blame that are not ethically relevant. One may praise someone’s good dress sense, and blame the weather for a crop failure.

** Black propaganda is false information and material that purports to be from a source on one side of a conflict, but is actually from the opposing side.

It is typically used to vilify, embarrass or misrepresent the enemy.[1] Black propaganda contrasts with grey propaganda, the source of which is not

identified, and white propaganda, in which the real source is declared and usually more accurate information is given, albeit slanted, distorted and

omissive. Black propaganda is covert in nature in that its aims, identity, significance, and sources are hidden.

** Media bias is the bias or perceived bias of journalists and news producers within the mass media in the selection of events and stories that are

reported and how they are covered. The term “media bias” implies a pervasive or widespread bias contravening the standards of journalism, rather

than the perspective of an individual journalist or article.

  49. lich tran says:

Lesson 2: Basic Education for AC Thompson, Tony Nguyen , FRONTLINE – PBS, ProPublica, OC Register
    Excerpt from en.wikipedia.org

** Richard Alan Nelson’s (2004) study cited above on Tracking Propaganda to the Source: Tools for Analyzing Media Bias[33] reports there are at least 12 methods used to analyze the existence of and quantify bias:
1.Surveys of the political/cultural attitudes of journalists, particularly members of the media elite, and of journalism students.
2.Studies of journalists’ previous professional connections.
3.Collections of quotations in which prominent journalists reveal their beliefs about politics and/or the proper role of their profession.
4.Computer word-use and topic analysis searches to determine content and labeling.
5.Studies of policies recommended in news stories.
6.Comparisons of the agenda of the news and entertainment media with agendas of political candidates or other activists.
    7.Positive/negative coverage analysis.
8.Reviews of the personal demographics of media decision makers.
9.Comparisons of advertising sources/content which influence information/entertainment content.
10.Analyses of the extent of government propaganda and public relations (PR) industry impact on media.
11.Studies of the use of experts and spokespersons etc. by media vs. those not selected to determine the interest groups and ideologies represented vs. those excluded.
12.Research into payments of journalists by corporations and trade associations to speak before their groups and the impact that may have on coverage.

** A technique used to avoid bias is the “point/counterpoint” or “round table”, an adversarial format in which representatives of opposing views comment on an issue. This approach theoretically allows diverse views to appear in the media. However, the person organizing the report still has the responsibility to choose people who really represent the breadth of opinion, to ask them non-prejudicial questions, and to edit or arbitrate their comments fairly. When done carelessly, a point/counterpoint can be as unfair as a simple biased report, by suggesting that the “losing” side lost on its merits.

** Another technique used to avoid bias is disclosure of affiliations that may be considered a possible conflict of interest. This is especially apparent when a news organization is reporting a story with some relevancy to the news organization itself or to its ownership individuals or conglomerate. Often this disclosure is mandated by the laws or regulations pertaining to stocks and securities. Commentators on news stories involving stocks are often required to disclose any ownership interest in those corporations or in its competitors.

  50. lich tran says:

Lesson 3: Basic Education for AC Thompson, Tony Nguyen , FRONTLINE – PBS, ProPublica, OC Register
    Excerpt from en.wikipedia.org

** Political bias has been a feature of the mass media since its birth with the invention of the printing press. The expense of early printing equipment restricted media production to a limited number of people. Historians have found that publishers often served the interests of powerful social groups.[38]

John Milton’s pamphlet Areopagitica, a Speech for the Liberty of Unlicensed Printing, published in 1644, was one of the first publications advocating freedom of the press.[39]

In the 19th century, journalists began to recognize the concept of unbiased reporting as an integral part of journalistic ethics. This coincided with the rise of journalism as a powerful social force. Even today, though, the most conscientiously objective journalists cannot avoid accusations of bias.[40]

** Mass media, despite its ability to project worldwide, is limited in its cross-ethnic compatibility by one simple attribute – language. Ethnicity, being largely developed by a divergence in geography, language, culture, genes and similarly, point of view, has the potential to be countered by a common source of information. Therefore, language, in the absence of translation, comprises a barrier to a worldwide community of debate and opinion, although it is also true that media within any given society may be split along class, political or regional lines. Furthermore, if the language is translated, the translator has room to shift a bias by choosing weighed words for translation.

** The apparent bias of media is not always specifically political in nature. The news media tend to appeal to a specific audience, which means that stories that affect a large number of people on a global scale often receive less coverage in some markets than local stories, such as a public school shooting, a celebrity wedding, a plane crash, a “missing white woman,” or similarly glamorous or shocking stories. For example, the deaths of millions of people in an ethnic conflict in Africa might be afforded scant mention in American media, while the shooting of five people in a high school is analyzed in depth

  51. lich tran says:

    ** False imprisonment
False imprisonment is a restraint of a person in a bounded area without justification or consent. False imprisonment is a common-law felony and a tort. It applies to private as well as governmental detention.

    ** False accusation
False accusations (or groundless accusations or unfounded accusations or false allegations or false claims) can be in any of the following contexts:
    Informally in everyday life.
    Quasi-judicially
    Judicially.
When there is insufficient supporting evidence to determine whether an accusation is true or false, it is described as “unsubstantiated” or “unfounded”. Accusations that are determined to be false based on corroborating evidence can be divided into three categories:[1]
    An allegation that is completely false in that the events that were alleged did not occur;
An allegation that describes events that did occur, but were perpetrated by an individual who is not accused, and in which the accused person is innocent.
An allegation that is partially true and partially false, in that it mixes descriptions of events that actually happened with other events that did not occur.

    ** Wrongful execution:
Wrongful execution is a miscarriage of justice occurring when an innocent person is put to death by capital punishment, the “death penalty.” Cases of wrongful execution are cited as an argument by opponents of capital punishment, while proponents suggest that the argument of innocence concerns the credibility of the justice system as a whole and does not solely undermine the use of death penalty.[1][2]

** False evidence, fabricated evidence, forged evidence or tainted evidence is information created or obtained illegally, to sway the verdict in a court case. Falsified evidence could be created by either side in a case (including the police/prosecution in a criminal case), or by someone sympathetic to either side. Misleading by suppressing evidence can also be considered a form of false evidence (by omission), however, in some cases, suppressed evidence is excluded because it cannot be proved the accused was aware of the items found or of their location.

** A false statement is a statement that is not true. Although the word fallacy is sometimes used as a synonym for false statement, that is not how the word is used in philosophy, mathematics, logic and most formal contexts.
A false statement need not be a lie. A lie is a statement that is known to be untrue and is used to mislead. A false statement is a statement that is untrue but not necessarily told to mislead, as a statement given by someone who does not know it is untrue.

** Legal abuse refers to abuses associated with both civil and criminal legal action. Abuse can originate from nearly any part of the legal system, including frivolous and vexatious litigants, abuses by law enforcement, incompetent, careless or corrupt attorneys and misconduct from the judiciary itself.[1][2]
Legal abuse is responsible not only for injustice, but also harm to physical, psychological and societal health.*[3]

** A miscarriage of justice primarily is the conviction and punishment of a person for a crime they did not commit. The term can also apply to errors in the other direction—”errors of impunity”, and to civil cases. Most criminal justice systems have some means to overturn, or “quash”, a wrongful conviction, but this is often difficult to achieve. In some instances a wrongful conviction is not overturned for several years, or until after the innocent person has been executed, released from custody, or has died.
“Miscarriage of justice” is sometimes synonymous with wrongful conviction, referring to a conviction reached in an unfair or disputed trial. Wrongful convictions are frequently cited by death penalty opponents as cause to eliminate death penalties to avoid executing innocent persons. In recent years, DNA evidence has been used to clear many people falsely convicted.

** Dirty tricks are unethical, duplicitous, slanderous or illegal tactics employed to destroy or diminish the effectiveness of political or business opponents. The term “dirty trick” can also be used to refer to an underhanded technique to get ahead of an opponent (such as sabotage or disregarding rules of engagement).

If such thing happened, then now is the time for whom being forced/threatened to contribute money can report to FBI, NewsPaper, speak out after 27 years (2016-1989)

The truth may be that nobody forced/threatened to contribute money. Instead of that, the Vietnamese Immigrant voluntarilly donated their money. For example, in Tran Truong Case, the money contributed volutarily almost million dollars. This made others envy. And It also make fake people borrow some organization name to do the wrong thing for their own benefits.

And the dead journalist in 1989 might be too envious to make false statement and cause the lost of his life. Why he did not report to FBI and waited for the Court judgement?

Moreover, if there was a threatening, FBI should investigate whether it was individuals wrongly doing under the name of the Front, or the leaders of the Front order. FBI should also investigage the killer acted as a lone wolf or an organization.

Please report to FBI if you see something wrong. Only FBI can tell the truth and confirm by the Court, not for individuals guess. In US, guesssing to defame the others may cost your life.
