Tony Nguyen: A Chance for Truth in Little Saigon

Tony Nguyen, director of Enforcing the Silence, responds to criticism of FRONTLINE and ProPublica’s new documentary investigating the murders of Vietnamese-American journalists, Terror in Little Saigon. An overview of the documentary and the controversies around it can be found here.

I’m a second-generation Vietnamese American. The son of a refugee who escaped Vietnam in 1975. Four years ago I released a documentary called ENFORCING THE SILENCE about Lam Duong (Dương Trọng Lâm), the first Vietnamese journalist to be assassinated on US soil. It was voted in by a screening committee to play at the 2011 Vietnamese International Film Festival in Orange County, California, but was ultimately pulled from the program for fear that it would incite anger and protest from older, anti-communist Vietnamese Americans, according to festival organizers. The festival told me the film’s treatment of a militant group called the Front was too harsh and inaccurate, that they were not a joke as one of my interviewees said. That’s fine. That’s their opinion. My philosophy is, keep it moving.

Fast forward to October 3, 2015. PBS Frontline and investigating reporting organization ProPublica broadcasted TERROR IN LITTLE SAIGON, a TV documentary written and directed by Richard Rowley with A.C. Thompson as the correspondent and lead reporter. I’m an associate producer on the show and have been involved since its inception. I helped guide the crew with ideas of who to focus on, what to look into, who to interview, and so forth. The box of research documents that A.C. is looking through in the film is mine. It was my idea for A.C. to reach out to Richard Rowley to direct, as I am a fan of his films (watch Oscar-nominated DIRTY WARS) and his exceptional cinematography. I also provided feedback on the show’s rough and fine cuts.

Some Vietnamese Americans are angry with the Frontline documentary’s portrayal of the older generation and what they see as an unjust focus on the Front, a group that law enforcement has linked to some of the journalist killings, if not all. Some say the show’s title, TERROR IN LITTLE SAIGON, is loaded and sensational. Okay. But terror is what Vietnamese American journalists themselves have used to describe the threats, the violence, the murders –“terrorism against newsmen.” The five Vietnamese journalists were all killed in areas where there are “Little Saigons” — San Francisco, Houston, Orange County, and Northern Virginia. The title may be a bit on the nose, but it is not an exaggeration of history.

Some say the program is another example of the white savior complex, of the white man swooping in to save the day. Uh, it’s an investigative film that follows an investigative reporter, A.C., as he investigates a cold case, the unsolved murder of investigative journalist Nguyen Dam Phong. In the show he meets with the victim’s family members and friends, law enforcement, those suspected of the killing or of ordering it. He even goes on the same journey as Dam Phong and tries to track down the Front’s military base in Thailand. And note: A.C.’s been an investigative reporter for over 15 years writing stories about grave injustices, one of which helped free an innocent man from jail, 13 years after his conviction. He’s been a correspondent on three prior Frontline shows that you can stream on its website. He is a hell of a truth-seeking reporter who views the slain Vietnamese journalists as his colleagues.

Tina Ha Giang of the newspaper Nguoi Viet interviewed me last week, but I guess she couldn’t fit any of my comments in her articles on the subject. What I told her was that I think the Frontline piece is a major breakthrough for achieving what I could not do in my film, and that is: include the on-camera voices and perspectives of victims’ family members and that of the suspected criminals, former Front members and leaders. This has never been done before on film. We even included former Front leader Nguyen Xuan Nghia talking about how this kind of show makes the Vietnamese American community look bad, as if the victims’ family members are not a part of the community.

What people are calling rumor and gossip of terror by the Front and its followers (threats, intimidation and physical violence) is documented in thousands of pages of FBI and police files and through interviews with former Front members and leaders, and with victims of their wrath. This includes testimony from current San Jose Councilmember Tam Nguyen who described being beat up by Front members in the early 1980s for things his newspaper wrote about the Front.

A few years ago during a panel where I was criticized for my film about Lam Duong, I replied that my film or any other shouldn’t be considered the definitive piece. Instead I encouraged others, especially Vietnamese Americans, to look into the murders of our journalists and see where leads and evidence take them.

Now, after the release of TERROR IN LITTLE SAIGON, some people are, predictably, attempting to label me a Communist agitator, a ridiculous assertion. They are suggesting my work on Lam Duong was underwritten by the Socialist Republic of Vietnam, which is bogus; in reality, the project was crowdfunded through Kickstarter and one person in Vietnam gave $20. So much for the great Commie conspiracy. And they are portraying A.C. Thompson and the Frontline team as dupes who were somehow swayed by my secret agenda.

The truth is a lot less exciting: We worked together to tell a difficult investigative story, following the facts wherever they led us.

As a community, what do we care about? Some Vietnamese Americans seem to care more about protecting a certain image of Little Saigon than holding the authorities accountable for failing to arrest the killers and those who terrorized the community. I am interested in investigating the murders of our journalists because solving them would not only bring closure to the victims’ family members, but I believe would do a tremendous service and provide resolution to all our communities around the country.

So, to me, what we have is an opportunity to call on the FBI and local police to re-open these cases and utilize the knowledge and experience we have today to help solve them. There are people in our communities who know the truth and I hope one or more of them will come forward and no longer remain silent. As Nguyen Dam Phong’s son Tu said, “For us, we just want an answer… [that] we never got from police or anybody.”

    It does not matter individual doing wrong thing, we should keep the idea of doing the right thing. For example, some peopple criticize the Church for collect donation for the poor in VN, and they said the leader use unfairly donation. They focus on individual negative or on how the Church collect donation rather than positive religion consegrate to mankind. They are not different than Communists. If you criticize any thing except you, then examine your trueself. It may be not ok.

    The best way to make you become great is congratulation/welcome anyone doing good and better than yours. If some one can give a poor, $10, you do not need to give the same poor $20. Instead of that, just really/honestly feel happy for both the poor and the giver. If you consider someone as Christ/Buddha/Mohamed, even they are not, then you give receive the spirituual of Christ/Buddha/Mohamed. Becoming a fan of someone is also a good way to improve yours. President Bill Clinton admired and became a fan of JF Kenedy. President Obama admired and became a fan of Bill Clinton. Canadian singer Taylor Swift admired and became a fan of Canadian singer Shania Twain. Shania Twain admired and became a fan of another country singer. A fan can do better the admired one

  6. The dead journalist in Texax said in his last newspaper that the Front forced/threatened Vietnamese Immigrants to contribute money.

    If such thing happened, then now is the time for whom being forced/threatened to contribute money can report to FBI, NewsPaper, speak out after 27 years (2016-1989)

    The truth may be that nobody forced/threatened to contribute money. Instead of that, the Vietnamese Immigrant voluntarilly donated their money. For example, in Tran Truong Case, the money contributed volutarily almost million dollars. This made others envy. And It also make fake people borrow some organization name to do the wrong thing for their own benefits.

    And the dead journalist in 1989 might be too envious to make false statement and cause the lost of his life. Why he did not report to FBI and waited for the Court judgement?

    Moreover, if there was a threatening, FBI should investigate whether it was individuals wrongly doing under the name of the Front, or the leaders of the Front order. FBI should also investigage the killer acted as a lone wolf or an organization.

    Please report to FBI if you see something wrong. Only FBI can tell the truth and confirm by the Court, not for individuals guess. In US, guesssing to defame the others may cost your life.

    Such evil journalists/film producers like you can explain why so many journalists are killed nowadays. Most of them may abuse the right to speak and cannot control their mouse for evil words. They lack of decency behaviours.

    A good and brave/ethical journalist/film producers is the one who bring the truth to fight againt the powerful and wrong doing of big organization such as China Communists/VC government, not against the Vietnamese immigrant who lose all thing, having no power, …

    ** A technique used to avoid bias is the “point/counterpoint” or “round table”, an adversarial format in which representatives of opposing views comment on an issue. This approach theoretically allows diverse views to appear in the media. However, the person organizing the report still has the responsibility to choose people who really represent the breadth of opinion, to ask them non-prejudicial questions, and to edit or arbitrate their comments fairly. When done carelessly, a point/counterpoint can be as unfair as a simple biased report, by suggesting that the “losing” side lost on its merits.

    ** Another technique used to avoid bias is disclosure of affiliations that may be considered a possible conflict of interest. This is especially apparent when a news organization is reporting a story with some relevancy to the news organization itself or to its ownership individuals or conglomerate. Often this disclosure is mandated by the laws or regulations pertaining to stocks and securities. Commentators on news stories involving stocks are often required to disclose any ownership interest in those corporations or in its competitors.

    identified, and white propaganda, in which the real source is declared and usually more accurate information is given, albeit slanted, distorted and

    omissive. Black propaganda is covert in nature in that its aims, identity, significance, and sources are hidden.

    ** Media bias is the bias or perceived bias of journalists and news producers within the mass media in the selection of events and stories that are

    reported and how they are covered. The term “media bias” implies a pervasive or widespread bias contravening the standards of journalism, rather

    than the perspective of an individual journalist or article.

THE MURDER OF OUR EXILED VIETNAMESE JOURNALISTS REMINDS US OF MANY HUNDREDS OF WRITERS, JOURNALISTES, BLOGGERS, HUMAN RIGHTS DEFENDERS VICTIMS OF ARBITRARY POLITICAL POWER, RELIGIOUS FANATICISM AND INTOLERANCE, SECRET POLICE SURVEILLANCE AND MAJOR ORGANIZED CRIME IN SEVERAL STATES IN THE WORLD, INCLUDING VIETNAM, CHINA, NORTH KOREA, IRAN, SYRIA, ERYTREA, MEXICO, HONDURAS, ETC. MAY WE BRING TO THE KNOWLEDGE OF YOUR READERS THE GLOBAL SITUATION AS REPORTED IN THE FOLLOWING ARTICLE :

    PERSECUTED, THREATENED WITH DEATH, DEPRIVED OF FREEDOM, WRITERS AND JOURNALISTS ARE ON THE ROADS OF EXILE.
    We do not forget, 20 years ago, on 10 November 1995, Ken Saro-Wiwa was executed by the Nigerian military dictatorship because he told the truth. And the murder of Anna Politkovskaya in Russia, on 7 October 2006 and that of Hrant Dink in Turkey, in January 2007, are the most glaring examples and revolting crime. Or, in Viet Nam, PEN International also mourned the painful and unjust death of blogger and teacher Dinh Dang Dinh occurred on 3 April 2014 at his home, after being sentenced in August 2012 to six years in prison. He was amnestied too late on 21 March 2014, when he was only a dying skeleton devoured by stomach cancer in prison. Shortly before his death, Dinh Dang Dinh said that when he discovered blood in his bowel movement, he formulated many requests to be admitted to a hospital for examination but that the camp warders beat him instead of giving him the adequate treatment he urgently needed. 69-year-old poet Nguyen Huu Cau serving a life sentence in lieu of a death penalty imposed in 1983 was also amnestied in March 2014 for health reasons: he suffers from severe heart failure, blindness in his left eye, failing vision in his right eye, and is almost deaf. While his release is welcome, he should never have been in prison in the first place. We continue to work together to raise public awareness to the plight of persecuted writers and journalists who are in jail for their writings or their opinion.

    As a reminder, sent by the RFI to Mali, Ghislaine Dupont and Claude Verlon were murdered on 2 November 2013. Since their atrocious death, blood does not stop flowing. Charlie Hebdo was reduced to ashes at the heart of Paris. Elsa Cayat, Jean Cabut, Philippe Honoré, Bernard Verlhac, Georges Wolinski, Stephane Charbonnier, Bernard Maris and Mustapha Ourrad were killed unjustly. Everywhere, pen and pencil continue to be confiscated or destroyed. Drawings, songs, poems are targets of arbitrary political power, religious fanaticism and intolerance, secret police surveillance and major organized crime.

    During the last 12 months, since 2 November 2014, according to PEN International, at least 49 writers, poets, journalists, bloggers, cartoonists, correctors and filmakers have been murdered, with impunity. We deplore 8 killings in France (Charlie Hebdo), 6 in Mexico (José Moisés Sanchez Cerezo, Ismail Diaz Lopez, Gerardo Nieto Alvarez, Juan Mendoza Delgado, Filadelfo Sanchez Sarmiento, Ruben Espinosa), 5 in Bangladesh (Avijit Roy, Washiqur Rahman, Ananta Bijoy Dash, Niloy Chakrabarti, Faisal Arefin Dipan), 5 in India (Jagender Singh, Sandeep Kothari, Raghavendra Dube, Malleshappa Madivalappa Kalburgi, Mithilesh Pandey), 4 in Iraq (Thaer Alali, Ammar Al-Sahahbander, Raed Al-Joubouri, Suahaa Ahmed Radhi), 2 in Brazil (Marcos de Barros Leopoldo Guerra, Evany José Metzker), 2 in the Philippines (Nerlita Ledesma, Gregorio Ybanez), 2 in Syria (Kenji Goto Jogo, Khaled al-Asaad), 2 in Turkey (Ibrahim Abdulkadir, Firaz Hamadi), 1 in Azerbaijan (Rasim Aliyev), 1 in Denmark (Finn Nørgaard), 1 in Egypt (Shaimaa El-Sabbagh), 1 in Guatemala (Danilo Lopez), 1 in Kenya (John Kituyi), 1 in Mozambique (Paulo Machava), 1 in Pakistan (Zafarullah Jatak), 1 in Peru (Fernando Raymondi Uribe), 1 in Poland (Lukasz Masiak), 1 in Somalia (Abdullahi Ali Hussein), 1 in South Soudan (Peter Moi Julius), 1 in Ukraine (Oles Buzyna), and 1 in Yemen (Abdul Karim Mohammed Al-Khaiwani).

    At the same time, the Writers in Prison Committee has recorded about 900 cases of attacks against our bearers of dreams and adventures, witnesses of human realities around the world. The PEN Congress in Quebec, last October, has adopted resolutions on the very critical situation of the freedom of expression, including those concerning Bangladesh, Ethiopia, Honduras, Iran, Mexico, China, Tibet, Viet Nam and Turkey, among many others.
    The Congress delegates have expressed their concern about the plight of women writers and men of letters among thousands of their compatriots reported missing in Mediterranean, in their actual deadly exodus. Exiled Vietnamese Writers recalled also the tragedy of many hundreds of thousands Vietnamese boatpeople refugees drowned under the seas in Asia-Pacific after the arrival of communist troops in April 1975.
    The 15 November 2015 will be the 34th World Day of the Imprisoned Writer, just 2 weeks after the 2nd International Day to End Impunity for Crimes against Journalists.
    On the occasion of these Days – Events, the Suisse Romand PEN Centre, one of the PEN International’s 145 Centres, addresses to you: Please join your voices to ours, to those thousands of writers, poets, journalists, bloggers, translators and publishers, as well as friends and sympathizers of PEN International, for supporting victims of the tragedies of those being persecuted and punished for freedom of expression.
    The following major cases, among many others, inspire to us profound concerns:

    – Juan Carlos Argenal Medina, Hondurian journalist, assassinated on 7 December 2013 because he would have had the courage to denounce corruption. The circumstances of his death have not been clarified. No progress in investigations

    – Raif Badawi, Saudi blogger and publisher, sentenced in 2012 to 10 years in prison, 1000 lashes, a fine, a travel ban for ten years and a ban on same duration to collaborate in the media for ‘’insult to Islam” and ” creating a Liberal website’’.

    – Amanuel Asrat, Eritrean poet, critic and editor of the major newspaper The Times. Arrested on 23 September 2001 during a crackdown on public and private media. Detained without charge nor trial.

    – Patiwat Saraiyaem et Pornthip Munkong, Khadija Ismayilova (f), Thai student and female student, arrested in August 2014, sentenced to 2 years and a half in prison for lèse-majesté crimes by participating in the staging of a play at Thammasat University in 2013.

    – Khadija Ismayilova, Azerbaijani investigative journalist, famous for his investigations into corruption at the top of the state and its critics, arrested on 5 December 2014 in a fabricated case. Sentenced on 1 September 2015 to 7 years and a half in prison for ”embezzlement and tax evasion’’.

    – Ho Thi Bich Khuong (f), Vietnamese blogger, human rights defender and author of a memoir in prison, satirical poems and online articles. Interviewed by foreign radio, she denounced the abuse of power against poor women peasants. In June 2006, her husband was mysteriously murdered in their village. Having served two previous prison sentences in 2005 and 2007, she was arrested again in January 2011 and sentenced in December 2011 to 5 years in prison and 3 years in probationary detention, for “propaganda against the Socialist state’’. Tortured in prison and badly beaten by common law detainees. Other aggressors broke her left arm during pre-trial detention. She still suffers from a long-untreated broken collarbone due to lack of adequate medical care. She has frequently been held in solitary confinement for protesting against detention conditions by hunger strikes. She is in very poor health.

  54. As A Vietnamese American living in a Vietnamese community, we hate violence. We hate terrorists. I hope they find the murderer who attacked the six Vietnamese journalists. I hope the Vietnamese community will stop being terrorized.

    • Just in case someone would put all of us all in the same basket (a basket case(?) bỏ chung một rọ. The term “community” is a misnomer. Bằng Phong – Đặng văn Âu who wrote the piece exposing The Front/Mặt Trận was a pilot in the South Vietnam Air Force.
      Sometimes I wonder about the one-size-fits-all moniker “cộng đồng” (community) I think more to the point it means “cộng đồng người Việt hải ngoại” (overseas Vietnames community). In the current brouhaha about the documentary “Terror in Little Saigon” (now aptly called docudrama), a number of people – specifically the Việt Tân people – (reincarnated from the Front/Mặt Trận) would have us believed that the docudrama would give the “community” a bad name!

      There are people who are activists and dissidents, struggling against the continuing excesses and abuses the government VN, they flatly do not support Mặt Trận/The Front or Việt Tân. They respect the honorable efforts and endeavors of those in the communities both back in VN and here who struggle against the current VN leadership for the very same things they abhor in The Front, namely human rights abuses, corruptions, lies, deceptions and excesses. So why does Việt Tân folks continually liken themselves to the “community”?

      Because by “đánh bùn sang ao” pulling their bloody wool over our eyes they would give the uninformed the mistaken notion that Frontline and ProPublica’s “Terror in Little Saigon” is attacking the (anti human rights violators) Vietnamese community and ipso facto would give ‘us’ (if we belong to this community) a black eye. Hogwash! This would be true only if all honorable Viet democratic idealists and activists – and esp. Viet journalists – who oppose VN today would aquiesce to the terror and murders of the 80’s. Aren’t they using the very same tactics of the communist whose terror and violence that we abhor and struggle against still persist until today?

      Some even say that those assassinations were justified because the victims were Communists or sympathizers (yes Dương Trọng Lâm, may fit the bill!) This is a blatant disregard of the truth. Journalists Đạm Phong, Lê Triết and other murdered victims are anti-communist, their transgressions and sins had been published articles denouncing the Front as charlatans and impostors, and the Front incursions into VN from the borders of Thailand and Laos are elaborate set ups, hoaxes designed to take advantage of the people anti-Communist climate of the time for money.

    You ‘re a good man
    Assure you that there is at least one old member of the QLVNCH who admire your effort of making “Enforcing the silence”, and those of A C Thompson, ProPublica, PBS.
    Had been a member of QLVNCH, spent time in “cai tao” plus 10 years under Communist VN I experienced varied political views of the Vietnamese which are generally so contradicted each others that they become somewhat uncontrolled themselves listening of the opposite side.
    Very hard to persuade both of these groups of persons.
    But we ask for justice solely FOR JUSTICE because FOR JUSTICE is our consciences.
    Furthermore, terror is a weapon of the cowards like robbers, party members, …. and they might strike again if we are not vigilant.
